http://www.nytimes.com/2010/10/29/nyregion/29young.html New plan for getting rich: 1. get infront of young children riding bikes 2. get hurt from crash 3. ??? 4. profit! In all seriousness, this successful suit against a child is retarded. Sure someone died, though not from the injury, but I don't see why the court sees the child as responsible due to negligence. Which part of the suit is also against the parents who were supervising, I still don't see why they are held responsible for a death that isn't attributed to the accident. If this doesnt get appealed, US legal system is f***ed
They really should've stated what caused the death, otherwise I'd be inclined to think that 3 months is a feasible time frame for complications to emerge after an operation on such an elderly woman.
It's currently stated that cause of death was due to unrelated causes. So if I can sue a child for major injuries without having to show decisive evidence, whats to stop people from doing it besides ethics and morals?
Unless they can prove a causaul relationship between her death and the accident then we can dismiss the dying part completely for the time being. That being said if you get rammed by a kid at full speed when they are racing on the sidewalk the parents are responsible for this. From the description which may or may not be accurate this was not some obscure, bad luck accident but a simple lack of judgement on the side of the mother of the kid and she is responsible for the accident.
I'm happy i'm not living in the US, seriously... "But Justice Wooten declined to stretch that rule to children over 4. On Oct. 1, he rejected a motion to dismiss the case because of Juliet’s age, noting that she was three months shy of turning 5 when Ms. Menagh was struck, and thus old enough to be sued." Seriously?
A four-year old is not legally considered old enough to appreciate the consequences of her actions along with other things, let alone old enough to face a lawsuit. But then again, what do you guys expect? This is West Moscow, not a typical American city, we're talking about.
