You need to be careful about your ISP's policy regarding downloads. But most of the time you can just call them up and call them idiots.

They have no way of proving you're actually downloading that material. They can only determine that you have visited a site that may have that sort of material up for grabs.

Tell them they have no right to determine what sites you can go to and unless they prove that you were downloading illegal material, they have no right to shut off your internet.

While they have a right to refuse service to anyone, you also have a right to the service you're paying for. Remember, if they continue to do this, you are entitled to at LEAST a refund of the services you paid for. If they cut it off at ANY time you are entitled to a refund if they fail to prove it or if you decide to move to a different provider.

    Yes, actually, it is.

I would switch providers and notify your company that you do not appreciate being spied upon.

Take a look at your end-user license agreement and contract that you have with the company. One of two things is happening:

    1) There is a clause in your contract that states they are allowed to monitor your individual account activity and take action without your consent. In this case, I would switch providers immediately as this is an invasion of privacy and is NOT legal unless you sign that document (or sign up for their service). As an addition to this, check to see when the last time their agreement was updated. They are REQUIRED by federal law to notify you of any changes to your agreement.

    2) There is no such clause and they're breaking the law. If this is so, I would report them to the Better Business Bureau and recommend legal action be taken. Mention nothing about your actually downloading illegal content. If questioned about it, say it was material from a friend.

Most EULAs contain a clause that states they don't have to notify you of changes though, once again making it leagal by your acceptance of it.

You have Cox Internet? Where are you located?

I have Cox and I've never had a problem. Are you using some of their software? A firewall? Anti-virus? Delete it immediately. It is clearly spyware.

I would suggest you contact me via AIM for some more help.

It's in my profile, or PM me.

Nono. Dude I use Cox as a provider. I'm in Gainesville, Florida.

You MUST have spyware from their company on your computer. This is MOST DEFINITELY ILLEGAL!!!!

I would PM me with your AIM immediately.

the thing about piracy is that it causes a loss of sales, which may or may not be illegal, but makes you an arse

but in my case, it causes no change in sales at all, because i'm too much of a lazy bastard to buy the albums even if i found a thousand dollars in my coat pocket. also, i loathe itunes.

    ...what the hell is cox?

Nice. So Cox DOES offer these services. They must be spyware ridden.

The ONLY way they can detect these downloads for sure is through some type of software like that. Otherwise they can only guess by looking at what ports you're using and the amount of data coming in and out. That's why they can't go after downloaders, only uploaders usually. They can identify a steady stream of data.

double posting jon, and i got it thru isohunt and they have recently had a lawsuit against them by comcast so i doubt they are helping any ISP

plus i think they mentioned regon and some law he passed somewhere about copywrited material

also i dont like how u just keep jumping from conclusion to conclusion whenever each one is proven wrong, come up with some proof of this and i might believe you.

I apologize. I was busy trying to help you guys out. I didn't realize no one had posted.

Anyway, I deleted it and start a new thread that I hope is helpful to everyone.

EDIT: @ Tweak , I'm sorry dude, but you're just going to have to believe me, I guess.

You're being set up by a company. Not by utorrent or by isohunt. They SEEDED that on PURPOSE knowing people will download it. Then they track you, via your IP address, back to your ISP and submit a complaint.

That is how your ISP knew what file you were downloading. They didn't know you had it on your computer. They simply assumed. Also, the torrent you were downloading probably has a tracker in it. It will let the original seeder know how much of that file exists on your computer while it is connected to the internet. That's how they know if you "have" it on your computer.

This practice is HIGHLY QUESTIONABLE IN LEGALITY!!!!!!!!!!!!

    But they do it anyway.

EDIT: Jumping from conclusion to conclusion as I eliminate possibilities is called troubleshooting.

Cox internet, huh? Never heard of them before. I would have to remember never to get those guys. But I doubt I'll ever switch from Comcast.

Joneagle_X, do you have like a degree in computers or something?

No. But I play on them all day and work on them all the time. And I have taken a lot of courses in them. I used to have a C+ certification, but I let it lapse.

I know every nook and cranny of every Windows Operating System since 95. If there's a problem, I probably know how to fix it. Or know how to find how to fix it.

I use my computer for everything. It's my baby.

I was just alarmed when tweak said he had this problem. I've heard of it before but I'm so careful about my downloads and those of my clients that I've never actually seen one in action. I'm trying to find a way to get this file without downloading it directly.

I want to see where this malicious code is. Isolate it. This HAS to be illegal. They're technically sharing their own stuff to catch you. It's entrapment at the least.
